India's state governor for West Bengal has dissolved Legislative Assembly after Chief Minister Mamata Banerjee allegedly refused to tender her resignation following an electoral defeat of the Trinamool Congress.

The reported order, issued under constitutional provisions, is said to have triggered an unprecedented administrative and legal controversy in the state, with questions raised over the legitimacy of the interim executive arrangement.

The claims suggest that although the Assembly’s five-year term had already concluded, the political transition became contentious after Banerjee declined to step down or assume a caretaker role pending the formation of a new government.

Opposition parties, including the Bharatiya Janata Party (BJP), have reportedly demanded her immediate removal, arguing that a defeated government cannot continue in office beyond its mandate.

However, under Indian constitutional practice, outgoing administrations typically continue in a caretaker capacity until a new government is sworn in following the certification of election results by the Election Commission of India.

Banerjee, according to the reported statements, rejected allegations of defeat and dismissed the election outcome as “manipulated,” further stating that she would neither resign nor submit a formal resignation letter.
