Process finalised for legitimizing interim government
The process of legitimizing the current interim government until a new Prime Minister assumes office through the upcoming 13th National Parliamentary Election is nearing completion. The Legislative Division of the Ministry of Law is currently reviewing the draft of the "Interim Government Ordinance, 2024" for final issuance, pending approval from the Advisory Council. Multiple officials from the Ministry of Law have confirmed this information.
Sources within the Ministry have indicated that the Cabinet Division is finalizing the draft ordinance for issuance by the Law Ministry. Various aspects are under review, especially to ensure that no legal challenges can be raised against the legitimacy of the current interim government in court. Efforts are being made to prevent any legal complications, and once completed, the ordinance will be finalized.
According to sources in the Legislative Division, several aspects have been finalized after careful consideration. For example, in the “Interim Government Ordinance, 2024,” the Chief Advisor and Advisors will have the same rank as those in the caretaker government, and their roles will be similar. This government will assist the Election Commission in discharging duties defined by the Constitution or other laws. The interim government will also manage overall law and order and handle critical national issues. Unlike the caretaker government, which primarily facilitates elections and power transition, the current interim government’s role includes implementing foundational reforms for democratic elections.
Moreover, the current government will aid in maintaining the quality of various works, ensuring timely completion, identifying obstacles to progress, resolving issues, supporting employees in fulfilling their duties, providing opportunities for employee engagement, obtaining constructive feedback from officials, directing Republic officials and employees, fostering strong relationships among team members, and making immediate decisions on complex matters. Additionally, the interim government will support the Election Commission in organizing a free, fair, neutral, and inclusive national parliamentary election. It has been decided that individuals under 25 years will not be eligible for appointment to the current Advisory Council.
Sources from the Legislative Division noted that the ordinance is intended to establish a legal framework for the current interim government, and it is likely to be issued within this month.
Regarding this matter, Dr. Asif Nazrul, Legal Advisor, told Views Bangladesh, “The draft of the ‘Interim Government Ordinance, 2024’ has been approved by the Advisory Council. After review and necessary amendments, if any, from the Legislative Division of the Ministry of Law, the ordinance will be issued.”
Attorney General Md. Asaduzzaman told Views Bangladesh, “This is a policy decision of the government. Such an ordinance may be issued to bring the government under a legal framework.”
