Turin Afroz's mother, brother can live in Uttara house: High Court

The High Court has quashed the status quo order of the trial court regarding former International Crimes Tribunal prosecutor Turin Afroz's mother Shamsunnahar Begum and Turin's brother Shishir Ahmed Shahnewaz living in a five-storey house in Uttara in the capital.

Declaring the rule issued in this regard as valid, a single High Court bench of Justice Md Selim gave the verdict on Wednesday (February 19).

Now there is no longer any legal obstacle to Shamsunnahar Begum and Shahnewaz living in that house, said the lawyer concerned.

Senior lawyer Zainul Abedin took part in the hearing on behalf of the petition while lawyer Mohammad Saiful Karim represented Turin Afroz.

Later, lawyer Zainul Abedin said that Shamsunnahar Begum and her son Shishir Ahmed Shahnewaz had been living in a five-storey house on Plot No. 15, Sector 3, Road No. 11, Residential Model Town in Uttara since 2002. However, Turin Afroz, using his power, evicted Shamsunnahar Begum and Shahnewaz from that house in 2017.

Later, Shahnewaz and Turin Afroz filed two civil cases with Joint District Judge's Court of Dhaka, claiming possession and ownership of the house.

On October 11, 2018, the Fifth Joint District Judge's Court of Dhaka issued a status quo order regarding the possession of the house after hearing the applications of both parties.

Shahnewaz then appealed to the District Judge's Court against the order of the Joint District Judge's Court.

Later, on January 19, 2023, the District Judge's Court upheld the order of the Joint District Judge's Court.

In March 2023, Shahnewaz filed a civil revision in the High Court against the order of the District Judge's Court on the status quo order.

On April 2, 2023, a single bench of Justice Md Zakir Hossain issued a rule asking why the status quo order regarding the occupation of the house in Uttara should not be declared illegal.

The High Court has declared this as correct today. With this, there is no longer any legal obstacle to Turin Afroz's mother and brother living in that house.
