Govt files leave to appeal against HC verdict on quota system
The state has filed a leave to appeal petition against a High Court verdict that invalidated the circular seeking to cancel the quota system in first and second class government jobs.
The leave-to-appeal petition was filed with the Appellate Division of the Supreme Court on Tuesday (July 16).
On July 14, the High Court released the full verdict declaring the 2018 government circular abolishing the freedom fighter quota in first and second-class government jobs illegal.
According to the 27-page High Court verdict released on the Supreme Court's website, the government has the authority to reform the quota system if deemed necessary or desired.
Justice KM Kamrul Kader and Justice Khizir Hayat of the High Court bench have pronounced the judgment.
The verdict stated that a 2012 High Court ruling, upheld by the Appellate Division in 2013, "observed that the reservation of 30% quota for the children of Freedom Fighters shall be followed strictly, and expunged the words 'if the quota cannot be filled up, the concerned post be kept vacant'."
It further stated that it would constitute contempt to disregard the decision of the Appellate Division.
