Interim govt's validity leave-to-appeal hearing set for July 16
The Appellate Division has scheduled July 16 for hearing a leave-to-appeal petition challenging the High Court's decision upholding the legality of the interim government led by Dr Muhammad Yunus.
A bench led by Chief Justice Syed Refaat Ahmed fixed the date on Tuesday (July 1), following a request for an expedited hearing by petitioner Advocate Mohsin Rashid.
The petition seeks to overturn the High Court's January 13 ruling, which dismissed Rashid's writ petition questioning the formation and oath-taking of the interim government. On February 25, Rashid filed the leave-to-appeal with the Appellate Division.
The High Court had ruled that the President acted in accordance with Article 106 of the Constitution by accepting the Supreme Court's advisory opinion in an exceptional situation. The court also noted that the events of the July-August 2024 mass uprising are part of national history, and termed the writ petition as "motivated, malicious and harassing."
