Legal notice served seeking Tk 5cr compensation for Sajid’s death

A legal notice has been served against the Barendra Multipurpose Development Authority (BMDA) and other responsible parties following the tragic death of two-year-old Sajid, who fell into an abandoned and unprotected deep tube well in the Barendra region.

The notice demands Tk 5 crore in compensation for Sajid’s family and immediate measures to secure all unprotected tube wells.

Supreme Court lawyer Advocate Md. Monirul Islam Mia issued the notice on Sunday (December 14).

It highlights that hundreds of abandoned and unguarded tube wells across Rajshahi, Chapainawabganj, and Naogaon districts pose serious risks, especially to children. The recent death of Sajid in a abandoned deep tube well in Quailhat Purbo Para village under Tanore Upazila of Rajshahi, reflects gross negligence and administrative failure on the part of the authorities.

Citing Articles 31 and 32 of the Constitution regarding the right to life and personal liberty, the notice calls for implementation of multiple measures within 15 days, including: Survey and identification of all abandoned tube wells, sealing, filling, or permanently closing them at state expense, legal action against those involved in illegal tube well installations, developing standard operating procedures (SOPs) for safe tube well management, strict monitoring to prevent unauthorized tube wells, disciplinary action against negligent officials.

The notice further warns that failure to implement these measures within the stipulated time will result in filing a public interest litigation (PIL) in the High Court Division.
