Order on leave-to-appeal over interim govt’s legality on Thursday

The Appellate Division will deliver its order on Thursday regarding the leave-to-appeal filed challenging the High Court verdict that upheld the legality of the oath and formation of the interim government led by Muhammad Yunus. The seven-member full bench, headed by Chief Justice Dr Syed Refaat Ahmed, fixed the date after completing the hearing on Wednesday.

Attorney General Md Asaduzzaman argued for the state, while Advocate Mohsin Rashid presented submissions on behalf of the writ petitioner. Barrister Ruhul Quddus Kajol and Advocate Mohammad Shishir Monir argued as interveners.

The hearing on the leave-to-appeal began on December 2. During the proceedings, lawyer Shishir Monir said, “People’s mandate is the greatest legitimacy. The basis of legitimacy is the people’s trust and confidence.”

Earlier, on November 12, senior Supreme Court lawyer Mohammad Mohsin Rashid made submissions during which the attorney general accused him of contempt for making disparaging remarks about the court. The Appellate Division later sought an explanation from him.

Last December, the lawyer filed a writ challenging the legality of the interim government’s oath. The High Court rejected it, saying no one could question the interim government as it held legitimacy granted by the people. He later filed the leave-to-appeal petition.
